What is Wrongful Dismissal?
Wrongful dismissal is a term used to describe a dismissal which is done in breach of contract. If an individual is dismissed in breach of contract they may be entitled to claim compensation for any financial losses they have suffered as a result of the breach of contract. By way of example – if any individual has a contract of employment which states that they are entitled to 6 months notice of termination but their employer only gives them 3 months notice, they will be entitled to claim wrongful dismissal and their claim could be worth up to 3 months pay – subject to their duty to mitigate their loss.
