What is a Witness Order?

 

An employment tribunal, or any other court, can order that a relevant witness attends a hearing, the application is usually made by one of the parties to a litigation to explain why that witness is necessary and why an order compelling their attendance is necessary. The application is normally done ex-parte which means the other side does not need to be informed. It is a handy tool in any Employment Tribunal but parties should exercise caution when deciding whether to make this application as it can backfire if the witness does not end up helping your case.
