What is TUPE?

 

TUPE is a law – the long name is Transfer of Undertakings (Protection of Employment) Regulations 2006.

TUPE offers protection to employees who are involved in business transfers or service provision changes.  In essence, when there is a business transfer or a service provision change those employees who are working for the business which is being transferred or the service provider, are afforded protection under TUPE. They transfer over to the new business or the service provider with their terms and conditions of employment protected.

TUPE can be a complex area of law as it is not always clear whether there is a business transfer or a service provider change as well as whether the individual is assigned to the part of the business which is transferred or another service provider is to provide the service.
