What is Gross Misconduct?

 

Gross misconduct refers to extreme behaviour which is so bad that the employer cannot be expected to continue to employ the person any longer.  The conduct must amount to a fundamental breach which is a breach which goes to the heart of a contract.

Common examples of gross misconduct are being intoxicated at work, harassing another person in the course of employment, theft, fraud, abusive behaviour and fighting.
