What is Without Prejudice?
The “Without prejudice rule” is designed to help parties try and come to a resolution of a dispute between them. The rule allows parties to speak or communicate freely in the comfort that their communication cannot be used in court against them (for example, as an admission of guilt) if they are unable to come to an agreement. If a communication is genuinely without prejudice it cannot be admitted in court as evidence, it remains completely confidential.
