What is a Zero Hours Contract?
A zero hours contract is a contract of employment under which there is no obligation for the employer to provide work. This is commonly referred to as an absence of mutuality of obligation and this is a key aspect of a zero hour contract.
The individual who is providing work under a zero hour contract is usually deemed to be a worker and not an employee. As a worker an individual has less employment rights than that of an employee. However, regardless of the label attached to working arrangement the Tribunal will consider the reality of the situation so that a worker may in fact (and in law) be an employee.
