What is Vicarious Liability?
Vicarious liability describes the circumstances when one party (usually the defendant or the respondent in a litigation) has liability for the acts of another person, in other words they are responsible for that other person’s acts.
In the context of employment law, this usually refers to the employer being responsible for the acts of its employees towards another person. There has to be sufficient connection between the employment context and the wrongdoer’s acts for there to be vicarious liability.
