What is a Strike Out?
Any party to a claim (the Claimant or the Respondent) can apply to strike out the other sides’ claim or response. Any application for strike out will be considered at a preliminary hearing so that the party who is facing a strike out will have an opportunity to make submissions to the Tribunal as to why the claim or response should not be struck out.
The Employment Tribunal can also list a hearing themselves to consider striking out. There are limited grounds on which these applications can be made including that the claim or response (or part thereof) they are scandalous, vexatious or have no reasonable prospects of success.
