For a Settlement Agreement to be legally binding, an employee must receive advice from an independent adviser on the terms and effect of the agreement. Therefore, almost all employers will pay a contribution towards the employee’s legal fees for doing this. This legal fee contribution is typically between £500 and £1,500 plus VAT.
Our fees will depend on the complexity of the agreement and whether you want to accept the terms or are looking to negotiate.
I want to accept the offer
If the terms of the Settlement Agreement are agreed, we can provide advice on a fixed fee basis.
Our fixed fee for Settlement Agreement advice starts at £500 plus VAT. We charge a further £250 plus VAT if the Settlement Agreement needs to be reaffirmed (i.e. a second document needs to be signed after the Termination Date). This means that in many situations we can fix our fee to your employer’s contribution meaning there is nothing further for you to pay. We usually invoice your employer directly.
I want to negotiate and/or I need advice on whether to accept the terms
If you are looking for advice on your potential claims or to negotiate the terms of the Settlement Agreement, our fees are likely to be higher than your employer’s legal fee contribution. If this is the case, we will inform you and provide you with a quote before you decide whether to instruct us. We can often negotiate a higher legal fee contribution from the employer.
